Official Sweepstakes Rules
Read these rules in full before entering. Entering constitutes acceptance of these rules.
No purchase or payment of any kind is necessary to enter or win. A purchase will not improve your chances of winning.
1. Sponsor
The sweepstakes is sponsored and administered by Pedro Mercado, [LEGAL ENTITY / DBA PENDING] (the "Sponsor"), [SPONSOR ADDRESS]. The Sponsor is solely responsible for the administration of the sweepstakes and for awarding the prize.
2. No purchase necessary
No purchase or payment of any kind is necessary to enter or win. A purchase will not improve your chances of winning. Consultations booked during the entry period carry a stated number of entries, and an equal number of entries is available at no cost through the free method of entry described in Section 5. Applying for financing, funding a project, or receiving a financing decision does not grant, increase, or improve entries, and does not affect the outcome of the drawing.
3. Eligibility
The sweepstakes is open only to natural persons who are legal residents of [ELIGIBLE STATES] and who are [MINIMUM AGE] years of age or older at the time of entry.
Employees, officers, and directors of the Sponsor, its affiliates, and its advertising and promotion agencies, and the immediate family members and household members of each, are not eligible. Void where prohibited or restricted by law.
4. Entry period
The entry period begins on [START DATE] and ends on [END DATE], [TIME ZONE]. Entries submitted before or after the entry period are void. The Sponsor's clock is the official timekeeping device for the sweepstakes.
5. How to enter
Method one — online entry. Complete the entry form on the sweepstakes page with your full name, email address, telephone number, and state of residence. Entry is free and no purchase or consultation is required.
Method two — consultation entries. A consultation booked and paid for during the entry period is issued entries according to its length: 25 entries for a 30 minute session, 50 entries for a 45 minute session, and 100 entries for a 60 minute session. The payment is consideration for the consultation service only and is not a payment for entries. [ENTRY ALLOTMENTS PENDING LEGAL REVIEW.]
Method three — free mail-in entry. Hand-print your full name, mailing address, email address, telephone number, state of residence, and date of birth on a plain 3" x 5" card and mail it in a stamped envelope to: Pedro Mercado, [LEGAL ENTITY / DBA PENDING], Attn: Vehicle Sweepstakes, [SPONSOR MAILING ADDRESS FOR FREE ENTRY]. Each card received is issued 100 entries, equal to the largest number of entries available through a consultation. Mail-in requests must be postmarked within the entry period and received by [RECEIPT DEADLINE]. One request per envelope. Mechanically reproduced entries are void.
All methods are entered into the same drawing and each entry is given equal weight. Entries that are incomplete, illegible, or that the Sponsor determines to be fraudulent are void. [ENTRY LIMIT PER PERSON PENDING LEGAL REVIEW.]
6. Prize and approximate retail value
One (1) prize is available: [PRIZE VEHICLE — YEAR, MAKE, MODEL]. The approximate retail value ("ARV") is [APPROXIMATE RETAIL VALUE]. The actual value may differ based on market conditions at the time of award; any difference will not be awarded.
The prize is awarded as-is with no warranty of any kind, express or implied, except any manufacturer's warranty that accompanies the vehicle. The prize is not transferable, and no substitution or cash equivalent is permitted except at the sole discretion of the Sponsor. Title, registration, insurance, licensing, and delivery costs beyond those stated are the responsibility of the winner. [PRIZE DELIVERY TERMS PENDING LEGAL REVIEW.]
7. Odds of winning
The odds of winning depend on the total number of eligible entries received during the entry period across all entry methods.
8. Winner selection and notification
The winner will be selected in a random drawing conducted on [DRAWING DATE] from among all eligible entries received. The drawing will be conducted by the Sponsor or its designated administrator, whose decisions are final and binding in all matters relating to the sweepstakes.
The potential winner will be notified using the email address and telephone number submitted with the entry, within [NOTIFICATION WINDOW] of the drawing. The potential winner must respond within [RESPONSE WINDOW] and may be required to complete and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release before the prize is awarded. If a potential winner cannot be reached, is ineligible, fails to respond within the stated period, or declines the prize, the prize may be forfeited and an alternate winner selected.
9. Taxes
All federal, state, and local taxes on the prize are the sole responsibility of the winner. The Sponsor will report the value of the prize to taxing authorities as required by law and may require the winner to provide taxpayer information for that purpose through a secure channel. Winners are encouraged to consult their own tax advisor.
10. Publicity release
Except where prohibited by law, acceptance of the prize constitutes the winner's consent to the Sponsor's use of the winner's name, city and state of residence, photograph, and statements for advertising and promotional purposes without further compensation. 11. Limitation of liability
By entering, entrants release the Sponsor, its affiliates, and their respective officers, directors, employees, and agents from any liability for any loss, harm, damage, cost, or expense arising out of participation in the sweepstakes or the acceptance, use, or misuse of the prize.
The Sponsor is not responsible for lost, late, misdirected, incomplete, or undeliverable entries, or for technical failures of any kind. If the sweepstakes cannot be conducted as planned, the Sponsor reserves the right to cancel, suspend, or modify the sweepstakes to the extent permitted by law. 12. Privacy
Information submitted with an entry is used to administer the sweepstakes and to contact the winner. Entry information is held separately from financing and advisory records. See the Privacy Policy for the full description of how information is handled.
13. Governing law and disputes
The sweepstakes and these Official Rules are governed by the laws of [GOVERNING STATE], without regard to its conflict of law provisions. Any dispute arising out of the sweepstakes will be resolved in the courts located in [VENUE]. [DISPUTE RESOLUTION CLAUSE PENDING LEGAL REVIEW.]
14. Winner's list
